This Privacy Policy explains how eAvio, d.o.o. collects, uses and protects Personal Data when visitors use our website, contact us, purchase a Subscription, use the eAvio Platform, communicate with us or otherwise interact with eAvio.

This Privacy Policy forms part of the Agreement.

1. Who We Are

For the purposes of this Privacy Policy, “eAvio”, “Provider”, “we”, “us” or “our” means eAvio, d.o.o.

2. Vocabulary

Terms used in this Privacy Policy have the same meaning as in the eAvio Platform Service Terms.

In particular:

  • “Customer” means the organisation or person ordering or using the eAvio Platform.
  • “User” means an individual authorised by the Customer to use the Platform.
  • “Personal Data” means information relating to an identified or identifiable person.
  • “Customer Data” means data entered into, uploaded to, generated in or processed through the eAvio Platform by the Customer or its Users.
  • “Platform” means the eAvio Platform.
  • “Platform Communications” means occasional communication sent by eAvio to Customers or Users about the Platform, service information, product updates, new features, aviation-related news, educational content, partner offers or other information connected with aviation or the Platform.
  • “Service Messages” means non-marketing communication necessary for account administration, security, billing, support, legal notices, operational notices, service availability, Platform changes or other service-related purposes.
  • “Marketing Communications” means promotional, commercial or marketing communication sent by eAvio, including product announcements, commercial offers, partner offers, referral offers, paid feature suggestions, newsletters or similar content.
  • “Partner Offers” means offers, promotions, referrals or information about third-party aviation-related services, tools, integrations or products that may be presented through the Platform, by email or through other communication channels.
  • “Communication Preferences” means opt-ins, opt-outs, unsubscribe settings, consent records, objection records or other settings used to manage whether a person receives certain types of communication.

3. Personal Data We Collect

We may collect and process the following categories of Personal Data:

  • name and surname;
  • business email address;
  • telephone number;
  • organisation name;
  • billing and invoicing details;
  • User account details;
  • login and access records;
  • User role and permission data;
  • support requests and communication history;
  • Platform usage data;
  • communication records;
  • notification records;
  • communication preferences, where technically available;
  • aircraft, pilot, instructor, student, member or staff data entered into the Platform by the Customer;
  • basic segmentation data, such as User role, organisation type, selected Plan or activated Modules, where used in accordance with this Privacy Policy and applicable law;
  • technical data such as IP address, browser type, device information and log data.

The exact Personal Data depends on how the Customer configures and uses the Platform.

4. Why We Process Personal Data

We process Personal Data for the following purposes:

  • to provide access to the eAvio Platform;
  • to manage User accounts and permissions;
  • to provide support and maintenance;
  • to process orders, Subscriptions and invoices;
  • to communicate with Customers and Users;
  • to send Service Messages;
  • to provide Platform functionality requested by the Customer;
  • to improve the security and reliability of the Platform;
  • to analyse technical issues and prevent misuse;
  • to comply with legal, tax and accounting obligations;
  • to provide aviation-related software functions requested by the Customer;
  • to send or display Platform Communications, where permitted by law;
  • to send or display product updates, feature announcements and information about new Modules;
  • to send or display aviation-related news, educational content and product newsletters;
  • to send or display information about Optional Services, paid User features or Partner Offers, where permitted by law;
  • to show relevant information based on basic User context, such as User role, organisation type, selected Plan, activated Modules or Platform usage context;
  • to manage Communication Preferences, unsubscribe requests and objections.

5. Legal Basis for Processing

Depending on the situation, we process Personal Data on the following legal bases:

  • performance of a contract;
  • compliance with legal obligations;
  • legitimate interest in operating, securing, maintaining and improving the Platform;
  • legitimate interest in communicating with Customers and Users about relevant Platform updates, service information, product improvements and aviation-related information, where permitted by law;
  • legitimate interest in presenting relevant Optional Services, paid User features or Partner Offers, where permitted by law and where such interest is not overridden by the rights and interests of the individual;
  • consent, where consent is required by law;
  • processing on behalf of the Customer under the Data Processing Agreement.

Where the Customer enters Personal Data into the eAvio Platform, the Customer is usually the data controller, and eAvio acts as the data processor.

Where eAvio processes Personal Data for its own purposes, such as account administration, billing, security, legal compliance, service analytics, Platform Communications, product news, Marketing Communications or Partner Offers, eAvio may act as an independent controller for that processing.

Marketing Communications and Partner Offers will be sent or displayed only where eAvio has a valid legal basis and where such communication is permitted under applicable data protection and electronic communication rules.

6. Customer-Controlled Data

The Customer controls the Customer Data entered into the Platform by its administrators, Users, employees, members, pilots, students, instructors or other authorised persons.

The Customer is responsible for ensuring that it has the legal right to enter, store and process such data in the eAvio Platform.

eAvio processes such data on behalf of the Customer only to:

  • provide the Platform;
  • maintain the Platform;
  • secure the Platform;
  • support the Platform;
  • comply with the Customer’s documented instructions;
  • comply with legal obligations;
  • protect the Platform, infrastructure and Users from security threats.

Where eAvio processes Personal Data for its own purposes, such as Platform Communications, product news, Marketing Communications or Partner Offers, such processing is not performed on behalf of the Customer and is governed by this Privacy Policy.

7. Platform Communications, Product News and Partner Offers

eAvio may occasionally send or display Platform Communications to Customers and Users.

Such communications may include:

  • important service information;
  • account-related information;
  • security notices;
  • Platform updates;
  • new feature announcements;
  • information about new Modules;
  • onboarding information;
  • tips for using the Platform;
  • aviation-related news;
  • educational aviation content;
  • product newsletters;
  • information about Optional Services;
  • information about paid User features;
  • information about Partner Offers;
  • invitations to webinars, demos or product presentations;
  • other relevant information connected with aviation, the Platform or eAvio services.

eAvio does not intend to send such communication excessively.

General product or aviation-related newsletters will normally be sent only occasionally, for example:

  • once per month;
  • once every two months;
  • at another reasonable interval depending on the relevance of the communication.

eAvio may also display relevant product information, feature announcements, paid feature suggestions, Partner Offers or aviation-related content inside the Platform.

Such content may be shown, for example:

  • in the administrative interface;
  • in the user-facing interface;
  • on dashboards;
  • in notification areas;
  • in onboarding flows;
  • in feature-related screens;
  • by email;
  • through other communication channels.

Some Platform Communications, Marketing Communications or Partner Offers may be based on basic User context.

This may include:

  • User role;
  • organisation type;
  • selected Plan;
  • activated Modules;
  • Platform usage context;
  • country or region, where relevant;
  • Communication Preferences, where technically available.

For example:

  • instructors may receive information about instructor-related tools;
  • student pilots may receive information about student pilot tools;
  • pilots may receive information about flight planning tools;
  • administrators may receive information about management, reporting or communication features;
  • Customers using aircraft tracking may receive information about related analytics or hardware services.

eAvio may in the future make optional paid features available to individual Users.

Such features may include, for example:

  • flight planning tools;
  • pilot tools;
  • instructor tools;
  • student pilot tools;
  • flight analysis services;
  • aviation software;
  • other aviation-related digital services.

Such features may be offered:

  • directly by eAvio;
  • directly by a third-party partner;
  • through an integration within the Platform;
  • through a referral link;
  • as an optional paid feature purchased by individual Users;
  • as an optional service purchased by the Customer;
  • through another commercial model defined separately.

Where eAvio presents, promotes or refers Partner Offers or Partner Services, eAvio may receive:

  • a referral fee;
  • commission;
  • revenue share;
  • marketing fee;
  • another commercial benefit.

Where applicable and required, eAvio will make reasonable efforts to disclose the commercial nature of such partner recommendations, referral links or promotional arrangements.

eAvio will not use sensitive Personal Data for targeted Marketing Communications or Partner Offers unless a valid legal basis exists and such use is permitted by applicable law.

8. Communication Preferences, Unsubscribe and Objection Rights

Where required by law, eAvio will provide Users with appropriate information and choices regarding Marketing Communications, Partner Offers and targeted Promotional Content.

This may include:

  • the ability to unsubscribe from marketing emails;
  • the ability to object to direct marketing;
  • preference settings where technically available;
  • separate consent where required by law;
  • information in this Privacy Policy about how communication and targeting are handled.

If a person objects to direct marketing or unsubscribes from marketing communication, eAvio will stop sending such marketing communication to that person where required by law.

Service Messages may still be sent where necessary for:

  • account administration;
  • security;
  • billing;
  • service operation;
  • support;
  • legal notices;
  • important Platform changes;
  • other non-marketing purposes.

9. Data Sharing and Service Providers

We may use trusted service providers to operate the Platform.

These providers may include:

  • cloud infrastructure providers;
  • hosting or infrastructure providers;
  • database providers;
  • email delivery providers;
  • SMS providers;
  • payment providers;
  • analytics providers;
  • support tools;
  • monitoring tools;
  • backup providers;
  • security service providers;
  • technical infrastructure providers.

These providers may process Personal Data only as necessary to provide their services to eAvio and must protect the data appropriately.

Where required by GDPR, eAvio will maintain information about relevant sub-processors and provide it to Customers upon request.

Where eAvio uses third-party providers for Partner Offers, referral links, embedded tools or optional paid User features, the role of such third parties may vary depending on the specific service.

Such third parties may act as:

  • service providers or sub-processors;
  • independent controllers;
  • commercial partners;
  • providers of their own third-party services.

Where Partner Offers or Partner Services are provided directly by a third party, the third party’s own terms, privacy policy and data protection role may apply.

10. Data Storage and Location

Personal Data may be stored in the European Union or in other locations where appropriate legal safeguards are in place.

Where possible, eAvio uses cloud infrastructure and technical service providers located within the European Union.

Where Personal Data is transferred outside the European Economic Area, eAvio will ensure that appropriate safeguards are in place, such as:

  • an adequacy decision;
  • Standard Contractual Clauses;
  • another lawful transfer mechanism;
  • additional safeguards where required by applicable law.

11. Data Retention

We keep Personal Data only for as long as necessary for the purposes described in this Privacy Policy, unless a longer retention period is required by law.

Customer Data is normally retained during the active Subscription.

After termination, Customer Data may remain available for export for a limited period, normally 30 days, unless otherwise agreed.

After that period, Customer Data may be deleted or anonymised.

If the service is suspended due to non-payment, Customer Data may be archived for up to 12 months, after which it may be permanently deleted.

Personal Data processed by eAvio as an independent controller may be retained for as long as necessary for:

  • account administration;
  • billing;
  • legal compliance;
  • security;
  • communication preference management;
  • handling unsubscribe or objection requests;
  • dispute resolution;
  • legitimate business records;
  • other lawful purposes described in this Privacy Policy.

12. Security

We apply reasonable technical and organisational measures to protect Personal Data against unauthorised access, loss, misuse, alteration or disclosure.

These measures may include:

  • access control;
  • password protection;
  • backups;
  • logging;
  • monitoring;
  • secure cloud infrastructure;
  • encrypted connections where technically available;
  • internal security procedures;
  • administrative access controls;
  • incident response procedures.

No cloud service can be guaranteed to be completely secure.

Customers are responsible for managing their own:

  • Users;
  • passwords;
  • permissions;
  • internal access rules;
  • administrator accounts;
  • device security;
  • internal security procedures.

13. User Rights

Individuals may have the right to:

  • access their Personal Data;
  • request correction of inaccurate data;
  • request deletion of data;
  • object to processing;
  • object to direct marketing;
  • request restriction of processing;
  • request data portability;
  • withdraw consent, where processing is based on consent;
  • lodge a complaint with a supervisory authority.

Where eAvio processes Personal Data on behalf of a Customer, requests relating to Platform User data should normally be addressed to the Customer first.

14. Cookies and Website Tracking

Our website may use cookies or similar technologies to:

  • operate the website;
  • improve user experience;
  • analyse website usage;
  • support security;
  • remember preferences;
  • support marketing activities.

Where required by law, non-essential cookies will be used only with the visitor’s consent.

15. Changes to this Privacy Policy

We may update this Privacy Policy from time to time.

The latest version will be published on our website.

If changes materially affect Customers or Users, we will notify them where reasonably possible.

Continued use of the website, Platform or services after the effective date of the updated Privacy Policy means that the updated Privacy Policy applies from that date.
