Hardware Terms

These Hardware Terms apply where eAvio provides, rents, sells, maintains or supports Hardware connected with the eAvio Platform.
They form part of the Agreement.
1. Vocabulary
Terms used in these Hardware Terms have the same meaning as in the eAvio Platform Service Terms.
In particular:
“Hardware†means physical devices or accessories provided, rented, sold, maintained or supported by eAvio, including aircraft trackers, SMS devices, RFID cards, magnetic keys, sensors, communication devices, SIM cards or similar equipment.
“Hardware Service†means any service connected with the use, maintenance, rental, sale, replacement, data communication or Platform integration of Hardware.
2. Hardware Scope
Hardware may be provided as:
- purchased Hardware;
- rented Hardware;
- Hardware included in a monthly service;
- demonstration Hardware;
- replacement Hardware;
- Hardware used for tracker, SMS or integration services.
The exact Hardware type, price, ownership model and included services are defined in the Order Confirmation, offer or invoice.
3. Ownership
Unless the Order Confirmation clearly states that Hardware is sold to the Customer, Hardware provided as part of a monthly service remains the property of eAvio.
The Customer must not sell, transfer, modify, open, reverse engineer or dispose of eAvio-owned Hardware without written permission.
At the end of the service, eAvio-owned Hardware must be returned in reasonable condition, except for normal wear and tear.
4. Customer Responsibility for Installation
Unless expressly agreed in writing, eAvio does not perform aircraft installation work.
The Customer is responsible for:
- physical installation;
- electrical connection;
- mounting;
- aircraft documentation;
- airworthiness review;
- certification or approval;
- compliance with national aviation rules;
- obtaining consent from aircraft owners or operators;
- ensuring that installation is performed by competent persons.
eAvio may provide basic installation instructions, wiring diagrams or technical guidance, but this does not replace professional installation or aviation approval where required.
5. Aviation Approval and Regulatory Compliance
Any installation, modification, use or operation of Hardware on aircraft remains the responsibility of the Customer.
eAvio does not act as an aviation authority, maintenance organisation, continuing airworthiness organisation, certifying body or approved installer.
If formal approval, certification, airworthiness assessment, logbook entry, minor change approval or authority acceptance is required, the Customer must arrange and manage it.
6. SIM Cards, Telecom and Data Costs
Unless expressly included in the ordered service, the Customer is responsible for providing and maintaining:
- SIM cards;
- mobile subscriptions;
- data plans;
- SMS costs;
- roaming costs;
- telecom fees;
- network coverage;
- operator contracts.
eAvio is not responsible for service failure caused by mobile network outages, poor coverage, SIM card issues, roaming restrictions, blocked cards, unpaid telecom bills or operator changes.
7. Hardware Service and Maintenance
Where Hardware maintenance is included in the monthly service, eAvio will make reasonable efforts to maintain, repair or replace defective Hardware.
Maintenance does not include damage caused by:
- incorrect installation;
- incorrect voltage or wiring;
- water ingress;
- mechanical damage;
- lightning or overvoltage;
- crash, accident or impact;
- unauthorised modification;
- misuse or negligence;
- normal battery degradation;
- operation outside technical specifications.
In such cases, repair or replacement may be charged separately.
8. Replacement Hardware
If Hardware must be replaced, eAvio may provide equivalent or functionally similar Hardware. Replacement Hardware does not need to be the exact same model if the replacement provides comparable functionality.
The Customer must return defective eAvio-owned Hardware upon request.
If the Customer does not return eAvio-owned Hardware, eAvio may charge the replacement value.
9. Hardware Availability and Communication Reliability
Hardware-based services depend on physical devices, power supply, antennas, network coverage, SIM cards, telecom providers, aircraft environment and third-party services.
eAvio does not guarantee continuous tracker communication, SMS delivery, mobile data availability or uninterrupted Hardware operation.
Tracker data, position reports and SMS delivery information should be treated as supporting information and not as the sole source of operational or safety-critical decision-making.
10. Loss, Theft or Damage
The Customer must inform eAvio without undue delay if Hardware is lost, stolen, damaged or no longer functioning.
For eAvio-owned Hardware, the Customer may be charged for loss, theft or damage outside normal wear and tear.
11. Return of Hardware
When a Hardware Service ends, the Customer must return eAvio-owned Hardware within 30 days, unless otherwise agreed.
If the Hardware is not returned, eAvio may charge the Customer for the Hardware replacement value and reasonable administrative costs.
